Section two of Article 22 of Law 34/2002 of 11 July, on the Services of the Information Society and Electronic Commerce (hereinafter LSSI-CE), sets forth the following:
1. Service providers may use data storage and recovery devices on the terminal equipment of recipients on the condition that the latter give their consent after being provided clear and complete information on the data use, in particular on the purpose of processing the data, pursuant to Organic Law 15/1999 of 13 December, on the Protection of Personal Information.
When technically feasible and efficient, the recipient’s consent to accept the processing of the data may be provided by using suitable parameters in the browser or other applications, as long as the recipient is required to take a specific action to configure said parameters when the data are installed or updated.
The above shall not impede the potential storage or technical access for the sole purpose of transmitting a message by way of an electronic communication network or, to the extent that is strictly necessary, to provide an information society service that is expressly requested by the recipient.
As stated in the “Guide to using cookies”, published by the Spanish Data Protection Agency (hereinafter AEPD) in 2013, the LSSI-CE is applicable to any type of file or device that is downloaded on the terminal equipment of a user for the purpose of storing data that may be updated or retrieved by the entity responsible for its installation. A cookie is one such general-use device. Thus, in what follows, these devices will be generically referred to as cookies.
Cookies used for any of the following purposes are exempted from complying with the requirements set forth in Article 22.2 of the LSSI-CE:
A cookie is a file that is downloaded to your computer when you visit certain websites. Among other things, cookies allow a website to store and retrieve information on your browsing habits or computer. Depending on the information they contain and on how you use your computer, they may be used to identify you.
As the AEPD’s “Guide to using cookies” states, cookies may be classified by the way in which the data they obtain are processed:
In compliance with what is set forth in Article 5 of Organic Law 15/1999 of 13 December on the Protection of Personal Information (hereinafter LOPD), you are hereby expressly, specifically and unequivocally informed that the information obtained from the cookies installed on your computer will be used to analyse your browsing habits on our website in order to ensure the quality, security and improvement of the services offered therein.
The information obtained through the cookies installed on your computer will be disclosed to:
Users who do not expressly consent to the installation of cookies but who continue to use the website or application are deemed to have provided this consent and are expressly informed by us of the possibility to block or delete cookies already installed on their computer by adjusting the options for the browser installed on their computer.
While the installation of cookies on your computer is optional, by rejecting their installation you may be limiting or preventing the operation of the website, which would make it impossible for us to provide services through said website.
Users can change cookie settings or block or disable cookies at any time. Please see the links below for how to do this on leading browsers:
