Section two of Article 22 of Law 34/2002 of 11 July, on the Services of the Information Society and Electronic Commerce (hereinafter LSSI-CE), sets forth the following:
1. Service providers may use data storage and recovery devices on the terminal equipment of recipients on the condition that the latter give their consent after being provided clear and complete information on the data use, in particular on the purpose of processing the data, pursuant to Organic Law 15/1999 of 13 December, on the Protection of Personal Information.
When technically feasible and efficient, the recipient’s consent to accept the processing of the data may be provided by using suitable parameters in the browser or other applications, as long as the recipient is required to take a specific action to configure said parameters when the data are installed or updated.
The above shall not impede the potential storage or technical access for the sole purpose of transmitting a message by way of an electronic communication network or, to the extent that is strictly necessary, to provide an information society service that is expressly requested by the recipient.
As stated in the “Guide to using cookies”, published by the Spanish Data Protection Agency (hereinafter AEPD) in 2013, the LSSI-CE is applicable to any type of file or device that is downloaded on the terminal equipment of a user for the purpose of storing data that may be updated or retrieved by the entity responsible for its installation. A cookie is one such general-use device. Thus, in what follows, these devices will be generically referred to as cookies.
Cookies used for any of the following purposes are exempted from complying with the requirements set forth in Article 22.2 of the LSSI-CE:
A cookie is a file that is downloaded to your computer when you visit certain websites. The information obtained through the cookies installed on your computer will be disclosed to:
You shall be deemed to provide your consent to the installation of cookies if you check the box for accepting the “Cookie Policy” that is made available for this purpose on our website.
Users who do not expressly consent to the installation of cookies but who continue to use the website or application are deemed to have provided this consent and are expressly informed by us of the possibility to block or delete cookies already installed on their computer by adjusting the options for the browser installed on their computer.
While the installation of cookies on your computer is optional, by rejecting their installation you may be limiting or preventing the operation of the website, which would make it impossible for us to provide services through said website.
