  1. Applicable law

Section two of Article 22 of Law 34/2002 of 11 July, on the Services of the Information Society and Electronic Commerce (hereinafter LSSI-CE), sets forth the following:

1. Service providers may use data storage and recovery devices on the terminal equipment of recipients on the condition that the latter give their consent after being provided clear and complete information on the data use, in particular on the purpose of processing the data, pursuant to Organic Law 15/1999 of 13 December, on the Protection of Personal Information.

When technically feasible and efficient, the recipient’s consent to accept the processing of the data may be provided by using suitable parameters in the browser or other applications, as long as the recipient is required to take a specific action to configure said parameters when the data are installed or updated.

The above shall not impede the potential storage or technical access for the sole purpose of transmitting a message by way of an electronic communication network or, to the extent that is strictly necessary, to provide an information society service that is expressly requested by the recipient.

As stated in the “Guide to using cookies”, published by the Spanish Data Protection Agency (hereinafter AEPD) in 2013, the LSSI-CE is applicable to any type of file or device that is downloaded on the terminal equipment of a user for the purpose of storing data that may be updated or retrieved by the entity responsible for its installation. A cookie is one such general-use device. Thus, in what follows, these devices will be generically referred to as cookies.

Cookies used for any of the following purposes are exempted from complying with the requirements set forth in Article 22.2 of the LSSI-CE:

  • Solely allowing communications between the user’s equipment and the network.
  • Strictly providing a service expressly requested by the user.

  1. Cookie types by purpose

A cookie is a file that is downloaded to your computer when you visit certain websites. Among other things, cookies allow a website to store and retrieve information on your browsing habits or computer. Depending on the information they contain and on how you use your computer, they may be used to identify you.

As the AEPD’s “Guide to using cookies” states, cookies may be classified by the way in which the data they obtain are processed:

  • Technical cookies: These cookies allow you to browse a website, platform or application and to use the different options and services it provides, such as monitoring traffic, exchanging data, identifying a session, accessing restricted areas, remembering the items that make up an order, processing a purchase order, processing a request to register or to take part in an event, using security elements while browsing, storing content for broadcasting video or sound or sharing content through social media.
  • Personalization cookies: These cookies allow you to access a service with some of its general characteristics predefined based on a series of criteria on your terminal, such as language, the type of browser being used to access the service, the settings for the region from which you are accessing the service, etc.
  • Analytical cookies: These cookies allow the party responsible for the cookies to track and analyse the behaviour of the users of the websites to which they are linked. The information collected with these cookies is used to measure activity on websites, applications or platforms and to compile browsing profiles for the users of said websites, applications or platforms for the purpose of making improvements by analysing the data on how users use the service.
  • Advertising cookies: These cookies are used to manage in the most efficient way possible the advertising space that an editor may have included on a website, application or platform from which the service requested is provided. They do so based on criteria such as the content published or the frequency with which the advertisements are shown.
  • Behavioural advertising cookies: These cookies are used to manage in the most efficient way possible the advertising space that an editor may have included on a website, application or platform from which the service requested is provided. These cookies store information on users’ behaviour that is obtained by constantly monitoring their browsing habits. This is used to develop a specific profile that is used as a basis for displaying advertising.
